
Terms and Conditions
The promoter of the competition is The National Trust for Scotland, Wemyss House, 28 Charlotte Square, Edinburgh, Scotland, EH2 4ET.
All participants must comply with the entry requirements stated in the competition website. The participant acknowledges that failure to comply with the rules may result in his or her disqualification from the competition.
Entry is restricted to those over the age of 18. Those involved in the promotion and execution of the draw, employees of the National Trust for Scotland and their families or agents may purchase units but will not be entered into the draw.
The competition is open to entrants in their own name only.
Each unit purchased will uncover a 5 pixel by 5 pixel square on the Trust’s on-line version of the painting of Robert Burns produced by Peter Howson. There are a total of 12,288 units available for purchase. The minimum number of units available is one and the maximum units available is the remainder left over from time to time.
In order to enter the competition the purchaser must answer correctly the competition question. Subject to the terms hereof, in the event that the purchaser has correctly answered the competition question then each unit purchased will entitle the purchaser to one entry in the competition.
You cannot change the name or message you submit, once they have been accepted. If your purchase (name and message) is accepted you cannot get a refund.
The site will be online until the National Trust for Scotland decides it is time to remove it but will remain until at least 1st Jan 2010.
No obscene or offensive messages will be accepted, and the National Trust for Scotland decides what is appropriate. If you submit a false name or message that is rejected for display, you will have the opportunity to provide an alternative. Your payment will be treated as a donation and will not be refunded. The copyright in all messages will be deemed to be assigned absolutely to the promoter.
No images will be accepted in lieu of messages, only text up to a maximum of 75 words.
Funds must be fully received and cleared before your pixels go live on the website and before your unit is entered into the competition.
There might be occasional downtime for site maintenance but all reasonable commercial attempts will be made to keep these to a minimum. The promoter is not responsible if the internet entry made by the participant is disrupted, unclear, distorted, undelivered, delayed or affected in any way beyond the reasonable control of the promoter or any third party employed by the promoter to administer competition entries. The promoter is not liable for any charges incurred by the participant for any such internet connection or e-mail.
Immediately on receipt of payment and acceptance of the message the name and message submitted and accepted will appear on the website.
In the event that there is more than one correct entry a winner will be selected at random by the National Trust for Scotland from all purchasers who have correctly answered the competition question. The date of the final selection is 30 June 2010 and the winner will be advised in writing within 28 days of the selection date. The prize is the original painting of Burns as pictured on the pixel site, actual size 6ftx4ft unframed. The National Trust for Scotland will not be responsible for costs or damaged incurred in the delivery of the painting to the winner. There is no cash equivalent prize.
The winner agrees to the publication of his name and county and for photographs to be taken and used for publication and/or future promotion by the National Trust for Scotland. The participants agree not to enter into correspondence or give interviews with any person other than the promoter on any matters arising from any competition without the prior written permission of the promoter.
The name and county of the winner will be available after the draw date by ending a stamped addressed envelope to Buy A Pixel, Fundraising Team, National Trust for Scotland, Wemyss House, 28 Charlotte Square, Edinburgh, Scotland, EH2 4ET.

All personal data provided by a participant to the promoter in connection with a competition entry will be used by the promoter, its employees, suppliers, contractors and agents to process the competition, to inform winning participants of their winning entry and to distribute prizes. A participant’s personal data, including any messages, video footage or photographs may also be provided to the police, law enforcement agencies or other regulatory bodies as part of any police, compliance, complaint or other investigation. All personal data provided by participants will be processed by the promoter in accordance with the promoter’s Privacy Policy.
To the fullest extent permitted by law, the promoter accepts no liability for any loss or damage of any nature whatsoever and howsoever arising out of or in connection with a participant’s entry into the competition (including the use of any prize) and the promoter’s use of the entry whether due to inaccuracy, error, omission or any other cause and whether on the part of the promoter (or its servants, agents or any other person or entity).
If the promoter is liable to a participant for any reason (other than death or personal injury arising from the promoter’s negligence), the promoter’s liability will be limited to £100. Notwithstanding any other provision of these rules, the promoter does not attempt to exclude or limit its liability for death or personal injury resulting from its negligence in any way.
To the fullest extent permissible by law, the promoter does not make any express or implied warranties, representations or endorsements whatsoever with regard to the competition prizes or any information, service or product provided in connection with a competition.
Unless otherwise stated, all competitions in the publications are controlled and operated by the promoter from its offices in the United Kingdom. Players who enter a competition from outside the United Kingdom do so on their own initiative and are responsible for compliance with all applicable local laws. If participation in a competition or the supply or use of a competition prize are contrary to or infringe any applicable law in a participant’s jurisdiction(s), the participant is not authorised to enter the competition.
If any provision or term of these rules shall become or be declared illegal, invalid or unenforceable for any reason whatsoever, such term or provision shall be divisible from the rest of the rules and shall be deemed to be deleted from them.
Any failure or delay by the promoter in enforcing an obligation or exercising a right, under these rules, does not amount to a waiver of that obligation or right or any other obligation or right.
The participant acknowledges that he or she has not agreed to these rules in reliance on any statement or representation, except in so far as the representation has been incorporated into these rules. The participant irrevocably and unconditionally waives any right the participant may have to claim damages and/or to rescind these terms and conditions by reason of any misrepresentation (other than a fraudulent misrepresentation) not contained in these terms and conditions.
These rules and all competitions included in the publications are governed by and construed in accordance with the laws of Scotland and the Scottish Courts will have exclusive jurisdiction to determine any proceedings in connection with this competition.
In the event that a promotion has generated no correct entry the promoter reserve the right to distribute the prize to incorrect entries based on a draw.
